What is a Customs Broker Licence and how we can get it !!!

Many people who are not aware about Customs Broker Licence have many queries in the mind regarding this. Let me explain in the easiest way :


Who is a Customs Broker ?

Customs Broker is a person (Including legal person) who have grated a licence for clearance of export-import shipments from the possession of Indian Customs. No person other than a licence holder can represent a client before Customs for Customs Clearance procedure. 

Although exporter or importer can Customs clear their cargo at their own, but same as an advocate needed to win a case in the court of law, a Customs Broker (CB) is needed to clear the cargo from Customs. Since a lay man is not suppose to have specific knowledge about export import and foreign trade related law, policies, notifications, and procedures, they need services of a Customs Broker for the smooth clearance of the Cargo.



Which Act and Regulations given a legal Standing to a Customs Broker ?

Indian Customs Act 1962, with Customs Broker Licensing Regulations 2013 have give legal standing to Customs Brokers.



What types of Exams are conducted by the Indian Customs ?

On behalf of Indian Customs, Customs Broker Examination at all India level is conducted by the Directorate General of Inspection, Customs & Central Excise (DGICCE) under rule 6 of CBLR 2013. Besides this G-card Exams also conducted by the same authority under rule 17(3) of CBLR 2013.



What is the qualification prescribed to appear in G-Card Exam under rule 17(3) ?

A candidate must be a higher secordary (12th) pass with an experience of 6 month holding a valid H-Card, can apply for G-Card exam. An H-Card is an identity card issued by department of Customs on behest of a Customs Broker.



What is the eligibility criteria to appear in Customs Broker rule 6 Exam. ?

The Criteria of eligibility for Customs Broker rule 6 exam is as follows:(A) The person includes legal person should:be a Citizen of Indiabe a person of  sound mindnot be an insolventnot be a convicted criminal.not have been penalised under Customs, Excise, or Finance Act 1994.(B) The Individual who personally would appear in the exam should:
be be a graduate from a recognised University, and posses a professional degree likeCALLBMBADiploma in Customs Clearance Work from a recognised universityORhaving  at least  two years experience  in  transacting  Customs Broker  work as G-Card holder;

HOW TO APPLY FOR GRANT OF CB LICENCE

            how to apply for a CB licence, what are the documents you need to prepare and submit to the Customs in order to take the licence.

1        ‘Form A’ duly filled and signed.
2        Form D - Notarised

4        Surety Bond in Form- E with PAN Card  of the Surety and ITR

7        TR 6 Challan Rs 5000 (Five Thousand) as license fee.
8        TR 6 Challan Rs 100  (Rs Hundred) as booklet fee.
9        PAN Card Copy of  the applicant
10    Copy of Certificate of Incorporation ………………………….
11    Copy of result of CHA Examination under regulation 8 (Written & Oral) of CHALR2004
